1. Acceptance of these terms

By accessing or using fidelitypricing.com or the Fidelity Lending Services pages hosted through WordPress.com (collectively, the “Site”), you agree to these Terms of Use and the Privacy Policy. If you do not agree, do not use the Site.

The Site is intended for adults who can legally enter into binding agreements. These terms apply only to use of the Site and do not replace the disclosures, authorizations, agreements, or notices provided in connection with a particular financing transaction.

2. Informational purpose only

Information on the Site is provided for general informational and educational purposes. It is not a commitment to lend, an approval, a preapproval, a rate lock, a loan estimate, a guarantee of terms, or an offer to enter into any transaction.

Program descriptions are summaries and may not include every eligibility requirement, cost, condition, or restriction. Program availability, rates, fees, loan amounts, collateral requirements, documentation, and terms may change without notice and remain subject to lender requirements, underwriting, appraisal, title review, verification, market conditions, and applicable law.

3. Brokerage services and third parties

Fidelity Lending Services provides real-estate financing brokerage and transaction-structuring services. Fidelity may communicate with lenders, capital providers, settlement providers, service providers, and other transaction participants when you ask us to explore financing. Fidelity does not represent that every product, lender, or capital source is available through Fidelity or appropriate for every transaction.

No financing relationship is created merely by visiting the Site, sending an inquiry, requesting a secure link, or discussing a possible transaction. A transaction proceeds only through the applicable application, disclosures, authorizations, underwriting process, and final written agreements.

4. Applications and communications

You agree that information you submit will be accurate to the best of your knowledge and that you are authorized to provide it. Do not impersonate another person, submit another person’s confidential information without authority, or use the Site for fraudulent or unlawful purposes.

Ordinary email and text messages are not secure channels for sensitive financial information. Do not send Social Security numbers, bank account numbers, full tax returns, identity documents, credit reports, or financial statements by ordinary email or text. Request and use the secure application or document-delivery method provided by Fidelity.

Sending an email, text message, or appointment request does not guarantee receipt, create an appointment, or require Fidelity to accept or pursue a transaction. Please wait for direct confirmation.

5. No professional advice

Nothing on the Site is legal, tax, accounting, investment, insurance, or appraisal advice. You should consult qualified professionals regarding your particular circumstances. Any examples, scenarios, transaction summaries, or property images are illustrative and do not promise that similar results, structures, or terms will be available.

6. Fair access and qualification

Financing inquiries are considered subject to applicable fair-lending and fair-housing laws. Qualification and final terms depend on the facts of the transaction, applicable program requirements, and lawful underwriting criteria.

7. Permitted use and intellectual property

You may use the Site for lawful personal or business evaluation of Fidelity’s services. You may not interfere with the Site, attempt unauthorized access, introduce malicious code, scrape or harvest information in a manner that disrupts the Site, misrepresent Site content, or use the Site to violate another person’s rights.

Unless otherwise stated, the Site’s text, layout, graphics, branding, and original materials are owned by or licensed to Fidelity Lending Services and are protected by applicable intellectual-property laws. You may view and print reasonable portions for your own noncommercial reference, but you may not reproduce, distribute, modify, or commercially exploit Site materials without written permission.

8. Third-party services and links

The Site may link to or rely on services operated by third parties, including WordPress.com, communications providers, scheduling tools, secure application providers, lenders, and other transaction participants. Those services are governed by their own terms and privacy practices. Fidelity is not responsible for third-party content, availability, security, or practices.

9. Disclaimer of warranties

To the fullest extent permitted by law, the Site and its content are provided “as is” and “as available.” Fidelity does not warrant that the Site will be uninterrupted, error-free, completely secure, or free of harmful components, or that information on the Site is complete, current, or suitable for a particular transaction. Rights that cannot lawfully be excluded remain unaffected.

10. Limitation of liability

To the fullest extent permitted by law, Fidelity Lending Services and its owners, personnel, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of or inability to use the Site, reliance on Site content, or interaction with a third-party service. This limitation does not apply where liability cannot legally be limited or excluded.

11. Changes and availability

We may update the Site, these terms, program descriptions, or Site availability at any time. The effective date at the top identifies the current version of these terms. Continued use of the Site after an update means you accept the revised terms.

12. Governing law

These terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where federal law controls. Nothing in these terms limits rights or remedies that cannot be waived under applicable law.
